Anti-Spam Policy
1.Our Position
MoxSend exists to make legitimate, wanted outreach land — not to industrialise spam. Deliverability is a shared resource: one abusive sender damages inbox placement for every customer on the platform. This Anti-Spam Policy is therefore a condition of using the Service, is incorporated into our Terms of Service, and is enforced by both automated systems and human review.
2.Laws You Must Comply With
You are responsible for complying with every law applicable to your sending, including without limitation: the U.S. CAN-SPAM Act; the EU/UK GDPR and ePrivacy/PECR rules; Canada's CASL; Australia's Spam Act 2003; India's DPDP Act 2023 and applicable TRAI regulations; and the telecommunications, cybercrime, and data-protection regulations of the UAE and the Kingdom of Saudi Arabia. Where laws conflict, the stricter standard applies to your sending through MoxSend.
3.Consent & Lawful Basis Standards
- You must have a lawful basis to email every recipient — consent, an existing business relationship, or (for B2B outreach where permitted) a documented legitimate-interest assessment relevant to the recipient's role.
- Cold outreach must be individually relevant, honest about who you are, and proportionate — mass identical blasts to unqualified lists are prohibited regardless of legal technicalities.
- Consent obtained by pre-ticked boxes, deception, or bundled terms does not count as consent under this Policy.
4.Prohibited Lists & Data
- No purchased, rented, harvested, or scraped lists.
- No appending of emails obtained from data brokers without a demonstrable lawful basis.
- No lists older than a reasonable recency threshold unless re-verified through MoxCheck before sending.
- No role-account carpet-bombing (e.g., blasting info@ / sales@ across thousands of domains).
5.Message Requirements
- Accurate header information, sender identity, and subject lines — no spoofing, no misleading "Re:" or "Fwd:" fabrications.
- A functioning, one-step unsubscribe mechanism in every message; opt-outs honoured within the shorter of ten (10) business days or the applicable legal deadline, and suppressed platform-wide for your workspace.
- A valid physical postal address where required by applicable law.
- No malware, phishing, deceptive links, or content that is unlawful in the recipient's jurisdiction.
6.Platform Enforcement Thresholds
We continuously monitor sending health. The platform enforces, automatically and without prior notice where necessary:
- Bounce gating: campaigns are blocked while projected bounce rates exceed the platform ceiling (2.0% target across major providers); MoxCheck verification is required to clear risky lists.
- Complaint ceiling: spam-complaint rates approaching 0.3% trigger throttling, mandatory list review, or suspension.
- Warmup pacing: new domains must respect MoxWarm ramp limits; attempts to bypass pacing are a material breach.
7.Consequences of Violation
Depending on severity, we may throttle sending, quarantine campaigns, require list re-verification at your cost, suspend the workspace, terminate the account without refund, and report unlawful activity to authorities. We may also remove content and notify affected mailbox providers where necessary to protect shared infrastructure.
8.Reporting Abuse
Anyone may report suspected spam sent through MoxSend to hello@moxsend.ai with the message headers. We investigate all reports and honour recipient suppression requests platform-wide.
9.Recipient Rights
If you received an unwanted email sent through MoxSend: use the unsubscribe link (it is suppressed immediately), and/or report it under Section 8. The sending customer is the controller of your personal data; our Privacy Policy explains how we assist with rights requests.
10.Changes & Contact
